This constitutes the biological opinion (Opinion) of NOAA’s National Marine Fisheries Service (NMFS) issued pursuant to Section 7 of the Endangered Species Act (ESA) of 1973, as amended, on the effects the U.S. Army Corps of Engineers permit (NAE-2019-01461) to allow Bath Iron Works Corporation (BIW) to perform maintenance dredging at a number of sites in support of their shipbuilding facility in the lower Kennebec River in Bath, Maine from 2020-2029.
