VIRTUAL HEARINGS, FAIRNESS AND IMMEDIACY IN THE PERUVIAN JUDICIAL SYSTEM

In the global context where the various areas of knowledge are transversalized by virtuality, it is essential to address and trace the processes of adaptation, being critical to address the implications within the legal system. In this order, the objective of the study was to analyze the incidence of virtual hearings on the principles of equity and immediacy in Civil and Criminal Courts in Peru, 2024. The approach was based on the socio-legal paradigm. Research of non-experimental, analytical and mixed design, formed by a sample of 147 legal operators of civil and criminal courts; applying the survey technique. The results showed that virtual hearings suffer from significant limitations that potentially compromise the principles of fairness and immediacy, mainly in terms of restrictions related to the interpretation of non-verbal communication and emerging technical difficulties that affect both the interaction between the parties and the ability of judges to make accurate assessments of the credibility of witnesses. The study concludes that the transition to virtual hearings in Peru requires a comprehensive reform of the judicial system to preserve fairness, immediacy and access to justice in the digital environment.KEYWORDS: Administration of justice, Civil rights, Mediation, non-verbal communication
