资源简介:
This study examines the principle of non-refoulement for refugees facing real risks through an in-depth analysis of a recent landmark decision issued by the Najaf Criminal Court in its cassational capacity. The research underscores the critical significance of this ruling in consolidating Iraq’s international obligations, particularly under the 1951 Geneva Convention, its 1967 Protocol, and the International Covenant on Civil and Political Rights (ICCPR). The decision represents a qualitative shift in Iraqi jurisprudence, affirming the primacy of binding humanitarian international norms (jus cogens) over conflicting national legislation, and obligating judges to apply these principles to safeguard human rights. The study details the legal basis of the ruling, which recognized the defendant’s official status as a refugee registered with the United Nations High Commissioner for Refugees (UNHCR) and found no legal grounds for deportation, citing the prohibition of returning individuals to territories where their life or freedom would be threatened. It draws parallels with international precedents, such as the European Court of Human Rights’ stance in M.S.S. v. Belgium and Greece, which prohibits expulsion to states where there is a risk of torture or inhuman treatment. Moreover, the research highlights the ruling’s creative legal dimension, where the court moved beyond narrow domestic legal provisions to interpret the Constitution and legislation in harmony with Iraq’s moral and humanitarian commitments before the international community. This judicial precedent stands as a vital reference in the evolution of national legal doctrine, reflecting a forward-looking Iraqi judiciary that embraces international human rights law, reinforces the hierarchy of legal norms, and actively contributes to the global pursuit of justice.
