Khula is the most accessible form of divorce for Muslim women in Pakistan but remains marred by discriminatory practices. Women seeking khula face significantly longer delays, averaging 231–318 days, compared to 164 days for men obtaining talaq. This disparity arises from a two-step reconciliation process imposed on women—first at the family court and then at the Union Council—despite no statutory or Islamic law basis for this requirement. In contrast, men undergo only one reconciliation attempt at the Union Council. This process increases both the time and cost for women seeking divorce. This paper explores the discrimination faced by women pursuing khula. It argues for legislative reforms to amend the Family Courts Act 1964 and Muslim Family Laws Ordinance 1961, eliminating the redundant Union Council procedure and recognizing family court decrees as final. Alternatively, decentralizing khula entirely to Union Councils could ensure parity with talaq.
