OSHA-Approved State Plans Reference 2026

The United States Occupational Safety and Health Administration (OSHA) allows states and territories to operate their own occupational safety and health programs under Section 18 of the OSH Act of 1970. As of 2026 there are 28 approved State Plans. Twenty-two cover private-sector employees as well as state and local government employees; six cover only state and local government employees (Connecticut, Illinois, Maine, New Jersey, New York, and the U.S. Virgin Islands), because federal OSHA retains jurisdiction over private-sector workers in those jurisdictions. This dataset lists every approved State Plan with its administering agency, scope classification, and—where the provisions are well-established in published rulemaking—notable standards that are unique to or stricter than the federal OSHA baseline. For plans where unique provisions are not confirmed in published rulemaking, the field notes that the plan follows federal OSHA standards and directs users to verify with the state agency directly, in compliance with the absolute-accuracy principle applied to this dataset. Users should verify current rule text with the relevant state agency before relying on any citation for compliance purposes, because state plans must be updated within six months of any change to the federal standard but the timing of formal adoption varies.
