In 1975, China established diplomatic relations with Thailand for the first time. Economic ties are a major driving force behind the growth of the Thai-Chinese relationship. In the last two decades, China has consistently sought foreign judgments circulations collaboration and has had success with a number of nations, including but not limited to the United States, Germany, Israel, and Singapore, through treaties and judicial practices. However, the same level of cooperation does not exist between China and Thailand, with the latter remaining silent on the implementation of foreign judgments in civil and commercial disputes. In terms of the economy, China is one of Thailand's largest trading partners and investors. In 2019, It accounted for 51.7% of all Foreign Direct Investment (FDI) projects submitted to BOI. However, there is no Sino-Thai legal method to securing the mobility of judgments, even though it is urgently needed. The purpose of this thesis is to identify legal instruments of the Sino-Thai judgments movement in civil a commercial case. Chapter II study the jurisprudence underlying the recognition and enforcement of foreign judgements. Chapter III research and make statistics on notable international conventions, multilateral agreements, and bilateral treaties from the perspective of the historical framework, principles, criteria, and procedures. Chapter IV examines the pan-Asian legal framework of international courts and regional treaties, as well as Thailand’s and China’s legal status. Chapter V analyses findings and makes recommendations mainly but not limited to the Sino-Thai bilateral agreement on judicial cooperation for civil and commercial cases recognition and enforcement.
