The article examines how European private law systems justify the transfer of title to movables in inter vivos transactions and how these approaches are reflected and partially reconciled in the DCFR. The author identifies three models: the consensual system (where the contract itself transfers title, as in French law), the causal transfer system (Roman-Dutch tradition), and the abstract transfer system (German law), demonstrating that each underpins a specific systematic organisation of civil law and different techniques for protecting acquirers, including those acquiring a thing a non domino. On this basis, the paper argues that the DCFR adopts a compromise solution: it autonomously qualifies acts directed at the transfer of title while maintaining a causal link between these dispositive acts and the underlying obligatory agreement, thereby combining systematic clarity with effective protection of the acquirer’s rights.
