VPRS 4068 Town Planning Appeals Files [Sample Only Retained]

Constituted under the Town and Country Planning (Amendment) Act 1968, the Town and Country Planning Board had the responsibility of promoting and coordinating town and country planning within the State. Under Section 14 of the Act the Town Planning Appeals Tribunal was established to hear and determine all appeals against decisions of responsible authorities with respect to applications for permits. Appeals were to be in writing and stating the grounds of the appeal with the following sections setting out the procedures and processes to be followed by the Tribunal in hearing and determining appeals.The series in custody consists of a sample only of the files in VPRS 4068 Town Planning Appeals Files and VPRS 3153 Town Planning Appeals Files. The sample was retained according to the provisions of PROS 91/10 Records Disposal Schedule for Records of the Administrative Appeals Tribunal as described above.File titling was primarily by the municipality and then by details of the appeal. Inside the front cover of the file a pro forma was pasted giving a summary of the dates and file number, that the appeal satisfied statutory conditions and the dates and recipients of relevant correspondence. The file contents are the appeal as forwarded to the Tribunal with exhibits and / or submissions; report of the appeal hearing which may include transcripts of personal submissions and correspondence with the parties to the appeal.Prior to 1974 when an appeal was refused, a three page summary was fixed as the final papers on the file referring to Section 19 of the Act and Section 4 of the Regulations. This summary detailed all aspects of the course of the appeal including proceedings, notifications and advertisements with notes indicating the checking of the accuracy of details.From 1974 the summary records were attached to all files. The previously described summaries were now streamlined. The cover summary dealt with dates of correspondence, hearings, any advertisements and to whom the report of the appeal needed to be forwarded whilst the file face sheet gave details of the parties to the appeal and the municipality involved.
