Royalty

In the legal doctrine the theme of the royalty as a bond from a concession contract with a local public authority is insufficiently approached independently. Many specialists in the legal field from the Republic of Moldova and Romania mention royalty in their works as the price of the contract or the payment obligation, the material part of the contract. Due to the fact that royalty in the delegation contracts of the services is not regulated nationwide, but setteled through the viewpoint of the legal regime by case-law of the concession contract, royalty and contractual clause, it is negotiated between the grantor and the concessionaire. The conceptual and legal gaps in the field of drinking water supply, sewerage and wastewater treatment allows public enterprises to develop activities in a very profitable field.在法学理论研究中，作为与地方公共主管部门签订的特许经营合同项下对价的特许权使用费（royalty）这一主题，尚未得到充分的独立探讨。摩尔多瓦共和国与罗马尼亚的诸多法学领域专家，在其著作中均将特许权使用费界定为合同对价、给付义务，亦即合同的实质性组成部分。鉴于服务委托合同中的特许权使用费未在全国层面得到统一规制，而是通过特许经营合同、特许权使用费及合同条款的法律规制框架，依托判例法进行调整，因此其相关条款由特许授予方与特许经营方协商议定。在饮用水供应、污水排放及废水处理领域存在的概念与法律空白，使得公共企业得以在这一极具盈利潜力的领域开展经营活动。
