资源简介:

Corporate bankruptcy laws play a crucial role in financial restructuring and business continuity, yet their effectiveness varies globally. This study examines how different legal frameworks impact restructuring success rates and corporate survival from 2019 to 2023. The research employs a secondary data approach, analyzing financial reports, legal case studies, and policy reviews across developed and emerging economies. Statistical analyses reveal a strong negative correlation (r = -0.970, p = 0.0153) between bankruptcy filings and restructuring success rates, indicating that while developed markets maintain a 65% success rate, emerging markets struggle at 30%. An ANOVA test confirms significant regional disparities, while a Chi-Square test highlights the association between bankruptcy and job losses, with emerging markets facing the highest employment disruptions (15%). The debt-to-asset ratio analysis shows that structured legal frameworks contribute to significant financial recovery, with North American firms reducing debt burdens from 0.80 to 0.55 post-bankruptcy. The study concludes that streamlined legal procedures, creditor-friendly policies, and proactive restructuring mechanisms improve financial stability and corporate survival. Key recommendations include legal harmonization, debtor-in-possession financing, and early intervention policies to mitigate liquidation risks. Enhancing corporate bankruptcy laws can foster economic resilience, investor confidence, and sustainable business practices.
