The Constitution of the Federative Republic of Brazil of 1988 dedicates a specific chapter to indigenous peoples, where, starting from art. 231, one can observe norms that recognize and protect the category in its social organization, customs, languages, beliefs, traditions and original rights over the lands that they traditionally occupy, with the Federal Union (federal entity) being responsible for, based on the disciplines of the Constitution, the demarcation, protection and respect for the assets that are the property of the original peoples in question. With regard to the organization and exercise of power to protect the human or legal consequences of all people, it is important to address the issue of federalism in Brazil, which, in a first and indispensable way, is to understand how issues and power relations occur in the national territory with regard to the achievement of issues that are important to society.
