随着全球环境恶化、资源消耗加快以及人们对环保问题的日益重视,聚焦于降低资源耗费、可再生资源开发、减轻环境污染等环保领域的绿色技术已经成为世界范围内的热门话题,鼓励和扶持绿色产业发展的相关政策频出,推动了绿色技术、环保产业的快速发展。但绿色技术的创造、应用、推广等过程都离不开知识产权制度,尤其是专利制度的保护,美国、英国、中国、欧盟、联合国气候变化大会等国家、地区、国际组织,开始从专利制度所具备的公共政策属性出发,结合绿色技术创新与发展的目标,对绿色专利制度予以实践探索。  绿色技术是指有利于节约资源、提高能效、防控污染、实现可持续发展的技术,主要包括替代能源、环境材料、节能减排、污染控制与治理、循环利用技术。目前我国正在积极探索绿色专利体系建设,特别是2017年8月施行的《专利优先审查管理办法》中明确提出:涉及节能环保、新一代信息技术、生物、高端装备制造、新能源、新材料、新能源汽车等国家重点发展产业可以请求优先审查。

Against the backdrop of global environmental degradation, accelerating resource consumption and growing public concern over environmental issues, green technologies focusing on reducing resource consumption, developing renewable resources and alleviating environmental pollution have become a global hot topic. Relevant policies encouraging and supporting the development of green industries have been frequently introduced, which has promoted the rapid growth of green technologies and environmental protection industries. However, the processes of creation, application and promotion of green technologies are inseparable from the protection of the intellectual property system, especially the patent system. Countries, regions and international organizations such as the United States, the United Kingdom, China, the European Union and the UN Climate Change Conference have started to conduct practical exploration of green patent systems, starting from the public policy attribute of the patent system and combining with the goals of green technology innovation and development. Green technologies refer to technologies conducive to resource conservation, energy efficiency improvement, pollution prevention and control, and sustainable development, mainly including alternative energy, environmental materials, energy conservation and emission reduction, pollution control and treatment, and recycling technologies. At present, China is actively exploring the construction of a green patent system. Specifically, the Measures for the Administration of Priority Examination of Patents, which came into force in August 2017, clearly stipulates that priority examination may be requested for technologies related to key national development industries such as energy conservation and environmental protection, new-generation information technology, biology, high-end equipment manufacturing, new energy, new materials and new energy vehicles.
