77. Monitoring of the resolution of denationalisation procedures before administrative authorities — situation as at 31. 12. 2021

According to previous reporting (situation as at 30. 9. 2021), the number of cases finally closed in administrative units increased by 4 from 38 386 to 38 390. However, the total number of pending cases in administrative units decreased from 54 to 48 during this three-month period. By the 77th follow-up of the completion of the process of denationalisation, 29 administrative units had completed the procedures in full, with all cases finally closed. At the first stage of decision-making, all cases are closed by 5 administrative units, namely UE Ajdovščina, Ribnica, Ruše, Šmarje pri Jelšah and Tolmin, which still have some cases under appeal. The Ministry of Culture, which decides at first instance on the denationalisation of objects protected under the regulations on the protection of cultural heritage, has 15 pending cases at first instance and 10 cases in the appeal, while the Ministry of the Environment and Spatial Planning, which decides at first instance on the recovery of property protected under nature conservation regulations, has 1 pending case at first instance and 4 cases under appeal. A total of 39 714 denationalisation claims were submitted for all administrative bodies at first decision-making stage (administrative units, MKGP, MOP and MF), of which 39,603 cases were finally closed, representing 99.72 % of the outturn in respect of all cases submitted. 111 cases remain pending, of which 64 are pending at first instance and 47 cases are still pending in appeals at second instance, administrative and Supreme Courts. Six denationalisation cases were resolved by the second-instance ministries over a period of three months. A total of 13 denationalisation cases are still pending at second instance.
