资源简介:
The series was used by the Prothonotary's Office to record details of all civil cases heard in the Supreme Court of Victoria which resulted in the Issuing of a Writ of Capias ad Satisfaciendum (Ca.Sa) or more commonly Fieri Facias (Fi.Fa). A Fi.Fa directs the Sheriff of the Supreme Court to seize assets from the debtor and to sell them at auction so as to arrive at a sum equal to the amount of a judgement debt and interest awarded to a creditor. A Ca.Sa which was rarely issued, is a writ for the arrest of the defendant when a judgement has been recovered against him for a sum of money and the creditor had not been satisfied. Such writs were normally sought against defendants who had been declared insolventDetails regarding these actions are entered across a double page. The pages are divided into columns noting the name of the defendant and plaintiff, the action number, date and type of writ issued, under what proceedings the writ was issued and the amount at stake. The final column headed Date and Nature of Return was rarely used.
