With respect to the dissertation titled “Governing Health Insurance in India: Legal, Institutional, and Regulatory Framework for Ensuring Access to Healthcare”, the present case analysis of the Kerala High Court judgement as herein, the court held that arbitrary denial of medical insurance claims by insurers amounts to violation of the fundamental right to life under Article 21 of the Constitution of India, as it essentially denies access to necessary medical treatment and healthcare. This ruling sets a significant precedent by elevating claim denials to a constitutional violation, critiquing how technical repudiations in private schemes exacerbate these fragmentation gaps, forcing household reliance on OOPE and also undermining Universal Health Coverage (UHC) goals.
