Laying of track 1: — Land development projects shall be established by the Flemish Government in accordance with the Decree of 28 March 2014 on land consolidation. At the time of the establishment, the area of the land development project is defined. One or more land development plans are drawn up for each land development project. The Flemish Landmaatschappij applies land development to set up areas in full in accordance with the area use (nature, agriculture, recreation, living, etc.) which has been granted in accordance with the town and country planning and provides a widely available ‘instrumentation kit’ for this purpose. — Land development projects, which were set up before the Decree of 28 March 2014 entered into force, were implemented pursuant to Article 6a and Articles 11 to 14 of the Decree of 21 December 1988 establishing the Flemish Land Company. That decree defines the term ‘land consolidation’ as ‘the promotion, preparation, integration and guidance of measures, actions and works emanating from the competent authorities aimed at safeguarding, revaluing and improving the suitability of rural areas, in accordance with the purpose assigned by the legislation on town and country planning.’ For each development project, one or more development plans were drawn up. The new 2014 legislation on land consolidation provides for a transitional regime for projects started before the entry into force of the new legislation. This transitional arrangement means that the establishment plans which have not yet been submitted to the municipal council for advice on 1 November 2014 are drawn up as land development plans in accordance with the new legislation on land consolidation. Laying of track 2: Other authorities or partners of the Flemish Land Corporation may also use the tools for installing the instruments in order to achieve certain purposes on the ground. Both the Flemish Government and the provincial or municipal level may decide to do so. The initiating authority will then start working in consultation with the VLM. Instrument suitcase: The toolkit is widely available in terms of fitting-out, management, land acquisition, land mobility and flanking policies. This includes, for example, fitting-out works, reparcelling and exchange of use. Since the new legislation, this has included: reparcelling in force of the law and the right of pre-purchase.
