Replication data for: Development and Outcomes of Investment Treaty Arbitration

A major question in investment treaty arbitration is whether it is biased against developing countries. This paper replicates the results from a frequently cited paper on this question (Franck, 2009) that failed to find statistically significant results on the question. I find that a simpler research design (with coding corrections to the author’s publicly available data) produces statistically significant support for developing countries being ordered to pay more than developed countries among those countries that are subjected to arbitration.
