Summary: The atlases of the neighbourhood roads were drawn up in accordance with the Law of 10 April 1841. This law on neighbourhood roads is still in force. The aim was to carry out an inventory of all “public” roads and “private roads with public easement”. In the period 1843-1845, bearings, public registers, of the neighbourhood streets were drawn up for all municipalities. These have entered history as atlases of neighbourhood roads. Each Atlas consists of 3 hatches: overview plan (s), detailed plans and tables. These are scanned and available at http://www.provant.be/bestuur/grondgebied/gis/atlas_buurtwegen/. Over the years, numerous amendments (abolishment, reclassification, deflections) were approved by the deputation at the request of the municipality. Each decision is accompanied by a plan (amendment document) which is kept separately. The digital Atlas of neighbourhood roads consists of 3 vector layers: The Atlas municipalities (former administrative division), the original neighbourhood roads and the changes. The ‘neighbourhood streets’ layer contains the original roads on the Atlas. These are neighbourhood roads (chemin), footroads (Sentier), railways (chemin de fer), large roads (grande route),... Doel: In 1841, the legislature intended to identify unequivocally which small roads were of a public nature. In fact, who owned (or is) the owner of the bed does not play any role. All these neighbourhoods are identified in the so-called atlas of the neighbourhood streets. The Atlas distinguishes between neighbourhood roads and pedestrian roads (Sentiers). Pedestrian roads are narrow roads, sometimes only 1 metres wide and the bed usually belongs to the landings. The deputation has the right to decide on the abolition of local and pedestrian roads. The deputatie has advisory rights (to the Flemish Minister for Spatial Planning) in the roilmining files [border between public highway and adjacent properties] of neighbouring roads. In the case of public property, the Decree of 8 May 2009 on the definition and implementation of the smoke lines shall apply. Under Article 9 of that decree, the opinion of the deputation is not required. Creation: The analogue atlases have been scanned and georeferenced on behalf of the Province. The atlas municipalities and amendments were subsequently signed. The neighbourhood roads themselves are sectorised on the basis of these files provided by the SW/Environmental Information Cell.
