VPRS 1400 Special Cases on Appeal from the District Courts of Mines

This series consists of Special Case Files on points of law contested in the Supreme Court, as appeals against cases heard in the Courts of Mines. Through the provisions of the Judicature Act 1884, the appeal jurisdiction held by the Chief Judge of the Courts of Mines, was transferred to the Supreme Court. Within fifteen days upon the determination of any Warden in Court of Mines, either party could apply to the Judge or Warden to reserve any question of law in the form of a special case for the opinion of the Supreme Court.If the Warden considered the appeal fit for the opinion of a higher jurisdiction, he submitted the special case enquiring on contested points of law to be heard before a full sitting of the Supreme Court. The court costs involved were thereby determined by the Court.These Special Case files comprise:- Praecipe to set down special case request to the Warden to set a date for the appeal by the Attorney of either party,- Special Case Statement by Warden presenting points of law contested,- "Exhibits" of evidence signed by witnesses presented before the Supreme Court,- ruling of the Court on the questions of law presented,- an account of the Court costs incurred.

本系列卷宗为针对矿业法院（Court of Mines）审理案件提起的上诉案件中，提交至最高法院（Supreme Court）的争议法律要点特殊案件卷宗（Special Case Files）。根据1884年《司法法（Judicature Act 1884）》的规定，原由矿业法院首席法官（Chief Judge of the Courts of Mines）行使的上诉管辖权，转由最高法院承接。在矿务专员（Warden）作出裁决后的十五日内，任何一方当事人均可向法官或矿务专员提出申请，以特别案情陈述的形式留存相关法律争议点，提请最高法院出具咨询意见。若矿务专员认为该上诉符合向上级司法机关征询意见的条件，则需将载明争议法律要点的特别案情陈述提交至最高法院全体合议庭进行审理。相关诉讼费用由该法院确定。本系列特殊案件卷宗包含以下内容：- 由任意一方当事人的诉讼代理人向矿务专员提交的、请求拟定特别案情陈述并确定上诉日期的令状（Praecipe）；- 矿务专员出具的载明争议法律要点的特别案情陈述书；- 提交至最高法院、由证人签署的证据展品（"Exhibits"）；- 最高法院就所提交的法律争议点作出的裁决；- 涉案诉讼费用明细清单。
