State-owned aquatic lands: Areas depicted as state-owned aquatic lands reflect DNR’s current understanding of where available evidence supports state title under the federal navigability-for-title test. Navigability and title are ultimately questions of federal law and may be resolved through court determination. Other ownership types: Other ownership shown reflects information available at the time of disposal or transfer. DNR generally maintains records of the original transaction but has no mechanism to track changes in ownership after disposal. Unclassified submerged lands: Submerged lands not classified on this map have not necessarily been assessed against the federal test of navigability. The absence of classification does not constitute a determination of non-ownership and does not relinquish DNR’s management authority.
