Law No 2014-58 of 27 January 2014 on the modernisation of territorial public action and the affirmation of metropolitan areas created a new category of public establishments: territorial and rural balance poles (PETRs). PETRs are public establishments set up by agreement between EPCI with own taxation, within a single enclave and without enclave, with a view to carrying out actions of common interest and drawing up a project for a territory defining the conditions for economic, ecological, cultural and social development within the perimeter of the territorial and rural balance pole. This territorial project specifies actions in the fields of economic development, spatial planning and the promotion of the ecological transition. PETRs are public establishments subject to the rules applicable to closed mixed trade unions, provided for in Article L. 5711-1 of the CGCT, subject to the provisions laid down in Article 72 of the Law, codified in Articles L. 5741-1 to L. 5741-5 of the CGCT. However, they differ from the rules of ordinary law by their creative regimes. This may include: an initial creation emanating from the desire of several own tax EPCI to group together in PETR. (Article L. 5741-1). a voluntary conversion of the mixed trade union composed exclusively of EPCI with own taxation and fulfilling the conditions laid down in Article L. 5741-1 of the CGCT (Article L. 5741-4). a conversion by the State representative of mixed trade unions which have been recognised as ‘Country’ within the meaning of Law No 95-115 of 4 February 1995 on guidance for the planning and development of the territory as drafted prior to the Law of 16 December 2010. EPCI members of associations or public interest groups carrying ‘Country’ may, inter alia, constitute a PETR, by consistent deliberations, pursuant to the provisions laid down in Article L. 5741-1 of the CGCT.
