To natural PPRs, the Environmental Code (L562-1) requires inter alia to “delimit areas exposed to risks, taking into account the nature and intensity of the risk involved, to prohibit any type of construction, construction, development or agricultural, forestry, artisanal, commercial or industrial operation, in particular in order not to increase the risk to human lives, or, in the event that agricultural, forestry, artisanal, commercial or industrial construction, works, developments or holdings may be authorised, prescribe the conditions under which they must be carried out, used or operated;” Thus, the territory concerned by the PPRI has been divided into two main types of regulatory areas, depending on the intensity of the 100-year flood hazard and the natural or urban character, or even heavily urbanised. In areas to be preserved from any new urbanisation, the ban prevails. In licence areas under conditions, new construction is possible by implementing risk adaptation measures. In addition, the RPRI identified two sub-areas managing land use at the rear of the protective structures.
针对自然PPR(PPRs)区域,《环境法典(L562-1)》除其他外作出如下规定:结合所涉风险的性质与强度划定风险暴露区域;禁止各类建设活动、开发项目以及农业、林业、手工业、商业或工业经营活动,尤其旨在避免加剧对人类生命的威胁;若农业、林业、手工业、商业或工业类建设项目、工程、开发活动或经营实体可获授权,则需明确其实施、使用或运营的必要条件。据此,受PPRI(PPRI)管辖的辖区已被划分为两类核心监管区域,划分依据为百年一遇洪水灾害的风险强度,以及区域的自然属性、城市属性或高度城市化特征。对于需严格禁止新增城市化行为的区域,相关禁令具有最高适用效力;在附条件许可区域内,通过落实风险适应性措施即可开展新建工程。此外,RPRI(RPRI)划定了两类子区域,用于管控防护设施后方的土地利用活动。
