Natura 2000 — Special Protection Areas (SPA) — Birds Directive in Burgundy-Franche-Comté

Directive 79-409 (EC) on the conservation of wild birds is an extension of the Paris Convention of 18 October 1950 on the protection of wild birds during their breeding and migration. It concerns the conservation of all migratory bird species living in the wild on the territory of the Member States, as well as their eggs, nests and habitats. Its purpose is to protect, manage and regulate its operation. To this end, States must take regulatory measures prohibiting the killing of these species and their intentional capture; intentionally damage their nests or eggs and remove their nests, collect their eggs, disturb them in particular during the breeding and dependence period, and keep birds whose hunting and capture are not permitted. The transport, offering for sale, sale, purchase or holding for sale of dead or living birds shall also be prohibited. The Directive also requires Member States to take measures to preserve, maintain or restore bird habitats. In order to maintain the diversity of habitats of these migratory birds, the Directive calls for the creation of protection zones, the maintenance and management of habitats within and outside the protection zones, the creation of biotopes or the recovery of destroyed biotopes.《（欧共体EC）第79/409号野生鸟类保护指令》是对1950年10月18日《巴黎野生鸟类繁殖与迁徙保护公约》的延伸。本指令适用于欧盟成员国领土范围内野生栖息的所有迁徙鸟类物种，及其卵、巢穴与栖息生境，核心目标为对相关对象实施保护、管理与运营规制。为此，各成员国必须出台规制性措施，禁止捕杀此类鸟类物种及故意捕捉；禁止故意损毁其巢穴或鸟卵、移除巢穴、捡拾鸟卵，禁止在繁殖及育雏期对其进行惊扰，同时禁止饲养狩猎与捕捉均属非法的鸟类。此外，对死亡或活体鸟类的运输、售卖邀约、售卖、购买或为售卖而持有等行为，同样应予禁止。本指令同时要求各成员国采取措施保护、维持或恢复鸟类栖息生境。为维持此类迁徙鸟类的栖息生境多样性，本指令呼吁设立保护区域，对保护区域内外的栖息生境进行维护与管理，创建生物群落生境或修复已遭破坏的生物群落生境。
