The INT1 category servitudes concern the servitudes instituted by Article L. 2223-5 of the General Code of Local and Regional Authorities in the vicinity of cemeteries extending within a radius of 100 metres around the new cemeteries transferred out of the municipalities. In this radius: — no one may, without authorisation, raise any dwelling or dig any well; — existing buildings may not be restored or increased without authorisation; — the wells may, after a contradictory visit of experts, be filled by order of the prefect at the request of the mayor. This easement does not have the effect of rendering the land included in this radius unconstructible but only of requiring the obtaining of a prior authorisation issued by the mayor pursuant to Article R. 425-13 of the Urban Planning Code. In accordance with Article R. 425-13, where the project concerns a construction less than 100 metres from a transferred cemetery, the building permit, the planning permit or the decision taken on the prior declaration shall be replaced by the authorisation provided for in Article L. 2223-5 of the General Code of Local and Regional Authorities once the decision has been agreed by the mayor, if the mayor is not the competent authority to issue the permit. This resource describes the generators of the INT1 easements, i.e. cemeteries transferred outside the agglomerated parts of rural or urban municipalities, but also existing cemeteries not transferred respecting the required distances from dwellings and wells. The generator of a public utility easement is a geographical entity whose nature or function induces, by regulation, constraints on the manner of land use of the surrounding land.The disappearance or destruction on the ground of the generator does not result in the removal of the easement or easements associated with it.
