Protected areas: interlocutory injunctions

The natural values of an area can be protected pending a decision on a nature reserve. The County Administrative Board or the municipality may issue a temporary ban (according to the Environmental Code) to take measures without authorisation that could harm the values they want to protect — an interim ban. Examples of measures that may conflict with the purpose of the intended nature reserve are felling, house requirements, construction of buildings or ditch cleaning. An often appropriate alternative to interim prohibitions is that the State or a municipality enters into a nature conservation agreement with the property owner, meaning that the owner refrains from felling forests during the lease period.
在拟定自然保护区(nature reserve)相关决策的过程中,可先行对区域内的自然价值实施保护。 郡行政委员会或自治市可依据《环境法典(Environmental Code)》发布临时禁令(interim ban),以禁止那些无需经过授权即可实施、却可能损害其拟保护自然价值的行为。与拟定自然保护区的保护目标相悖的典型措施包括林木砍伐、住宅建设需求、建筑施工以及沟渠清淤。 相较于临时禁令,另一种常被选用的适宜方案是,由国家或自治市与产权所有者签订自然保护协议,约定产权所有者在租赁期限内不得从事林木砍伐活动。
