Avanços, retrocessos e estagnações: um balanço da Lei 12.485

After 4 years of discussion and passage through the Chamber of Deputies and the Senate, the law 12.485 approved by the President of the Republic, on the 12th of September of 2011, still divides opinions about the real increase of the competitiveness, the inclusion of small producers and the increase of the offer of the national content. In this sense, the present paper analyses the firsts changes that occurred in the niche of the Pay TV after the implementation of the law which regulates the conditioned access audiovisual communication, considering that 2014 is the year of the full force of the law regarding the minimum amount of time of Brazilian content in the qualified space channels. The documents available in the website of Ancine which deal with the conditioned access audiovisual market were analysed and one finds that the large media conglomerates have been using various strategies in order to bypass the law and keep the market virtually unaltered; and that the increase in the amount of the offer of Brazilian content is still incipient.

历经四年之久的讨论，该法案于2011年9月12日经共和国总统批准，编号为12.485。然而，关于该法案真正提升竞争力、纳入小规模生产商以及增加国内内容供应的实际效果，时至今日仍存在诸多争议。本文旨在分析法案实施后，付费电视领域所发生的初步变化，特别是考虑到2014年，法案中关于合格空间频道中巴西内容最低播出时间的条款已全面生效。通过对Ancine网站提供的有关条件接入视听市场文档的分析，我们发现大型媒体集团已采取多种策略规避法规，使得市场几乎未发生实质性变化；同时，巴西内容供应量的增加仍处于起步阶段。
