在城市、慎规划区内以划拨方式提供国有土地使用权的建设项目，经有关部门批准、核准、备全后，建设单位应当向城市、是人民政有城多规划主管部门提出建设用地规划许可申请，由城市、县人民政府城多规划主曾部门依据控制性详细规划核定建设用地的位置、面积、允许建设的范围，核发建设用地规划许可证，建设单位在取得建设用地规划许可证后，方可向县级以上地方人民政府土地主管部门申请用地，经县级以上人民政府审批后，由土地丰管部门划拨土地。

For construction projects where state-owned land use rights are provided through allocation within urban and town planning zones, the construction entity shall submit an application for construction land planning permission to the urban-rural planning authority under the people's government at the city or county level after being approved, verified and filed by the relevant authorities. The urban-rural planning authority under the people's government at the city or county level shall, in accordance with the regulatory detailed planning, verify the location, area and permitted construction scope of the construction land, and issue the Construction Land Use Planning Permit. Only after obtaining the Construction Land Use Planning Permit may the construction entity apply for land use from the land administrative department of the local people's government at or above the county level. Upon approval by the people's government at or above the county level, the land administrative department shall allocate the land.
