NRS-9497 | Internal correspondence files [Accident Compensation Inquiry]

The terms of reference for the Accident Compensation Inquiry were established by the Attorney General, the Honourable F. J. Walker, Q.C., MP on 12 November 1981. Its purpose was to inquire into, report on and make recommendations concerning the extent to which compensation should be payable in respect of death or personal injury. The Inquiry was to consider: (1) whether 'no-fault compensation' should be payable in respect of death or personal injury suffered by any person through the use of a motor vehicle or other means of transport. (2) whether 'no-fault compensation' should be payable in respect of death or injury suffered by any person in circumstances other than the use of a motor vehicle or other means of transport. (3) whether a 'no-fault compensation' scheme or schemes should be introduced in New South Wales and, if so, to consider further the nature and scope of any such scheme. (4) whether any 'no-fault compensation' scheme should be in substitution for all or any rights to compensation under existing law. (5) whether the principles and practices relating to compensation for death or personal injury under workers' compensation legislation, other legislation, the tort or common law system should be modified and, if so, in what way.This series is comprised of thirty eight subject files. The folders contain a wide variety of material including: minutes and agenda; memos; publications; correspondence; submissions; research proposals and surveys. The files appear to have been established by an officer of the Commission who was concerned with administrative matters relating to the Inquiry. The files bear an "I" prefix and are numbered 1-38. (Files I3, I11, I12D and I20 were not received by State Records.) Some files or part files have been removed from series NRS 9500Submissions 1981-1984 [12/12803-06] and placed in this series (in file I.12 "Confidential matters - submissions"). 本次事故赔偿调查的职权范围由时任总检察长、尊敬的F·J·沃克（Honourable F. J. Walker, Q.C., MP）于1981年11月12日正式确立。其核心宗旨为：针对死亡或人身伤害相关赔偿的支付范围展开调查、出具专项报告并提出针对性建议。本次调查需重点考量以下五方面内容：

4. 某一项无过错赔偿方案是否应当替代现行法律下的全部或部分法定赔偿权利；
5. 针对工人赔偿立法、其他专项立法以及侵权行为法或普通法体系下的死亡与人身伤害赔偿相关原则与实践，是否应当进行调整，若调整则需明确具体调整方式。

本系列共包含38个主题档案盒，档案内涵盖丰富多样的材料，具体包括：会议纪要与议程、备忘录、官方出版物、往来函件、正式意见书、研究提案与调查问卷。上述档案均由负责本次调查行政事务的委员会官员创建，统一以“I”作为前缀，编号范围为1至38。（州档案馆未接收档案I3、I11、I12D及I20。）
