资源简介:
The terms of reference for the Accident Compensation Inquiry were established by the Attorney General, the Honourable F. J. Walker, Q.C., MP on 12 November 1981. Its purpose was to inquire into, report on and make recommendations concerning the extent to which compensation should be payable in respect of death or personal injury. The Inquiry was to consider: (1) whether 'no-fault compensation' should be payable in respect of death or personal injury suffered by any person through the use of a motor vehicle or other means of transport. (2) whether 'no-fault compensation' should be payable in respect of death or injury suffered by any person in circumstances other than the use of a motor vehicle or other means of transport. (3) whether a 'no-fault compensation' scheme or schemes should be introduced in New South Wales and, if so, to consider further the nature and scope of any such scheme. (4) whether any 'no-fault compensation' scheme should be in substitution for all or any rights to compensation under existing law. (5) whether the principles and practices relating to compensation for death or personal injury under workers' compensation legislation, other legislation, the tort or common law system should be modified and, if so, in what way. This series is comprised of thirty eight subject files. The folders contain a wide variety of material including: minutes and agenda; memos; publications; correspondence; submissions; research proposals and surveys. The files appear to have been established by an officer of the Commission who was concerned with administrative matters relating to the Inquiry. The files bear an "I" prefix and are numbered 1-38. (Files I3, I11, I12D and I20 were not received by State Records.) Some files or part files have been removed from series NRS 9500Submissions 1981-1984 [12/12803-06] and placed in this series (in file I.12 "Confidential matters - submissions"). They are files S3, S4, S11, S33, S82, S88, W61 and W90. (12/12812-18). 7 boxes. Note: This description is based on Concise Guide to the State Archives of New South Wales, 3rd Edition 2000.
