VPRS 769 Applications under Section 35 Amending Land Act 1865

This series consists of applications made under Section 35 of the Amending Land Act 1865 relating to the sale of lands. Applications are enclosed in a folder upon which are annotations regarding the completion of administrative actions and the entry of details in an Auction Book. Further research is required regarding this series.The application gives the details of the land sale, the amount of money forwarded as payment for the land, details of the location and extent of the land and the name, address and occupation of the purchaser. Accompanying this is a draft for a grant by purchase which has the same details as the application with a survey description of the land. Some applications may also include correspondence from the applicant.Section 35 of the Amending Land Act 1865 provided that lands unsold at a public auction could subsequently be applied for and sold if the price offered was the existing upset price (the minimum acceptable) or a higher price. This succeeded the same provision in Section 42 of the Land Act 1862 (see VPRS 831).
