资源简介:
According to previous reporting (situation at 31. 12. 2022) the number of cases finally closed for administrative units remained unchanged (38.401 case). However, the total number of pending cases for administrative units increased by 1 in this three-month period (from 45 to 46 pending cases). The above points to the fact that the resolution of denationalisation procedures by administrative bodies has persistently stagnated and in order to avoid possible damages due to the length of the proceedings or the inability to use national property (compensation under Article 72 of the ZDen) it would be necessary to take any measures at the government level. By 82nd follow-up of the proceedings, 32 administrative units were fully completed, with all cases finally closed, while at the first stage of the decision-making all cases were closed by two administrative units, namely UE Domžale and UE Ruše, which have some cases still under appeal, and 24 administrative units have still pending proceedings. The Ministry of Culture, which decides at first instance on the denationalisation of objects protected under the regulations on the protection of cultural heritage, has 13 pending cases at first instance and 11 cases in the appeal, while the Ministry of Natural Resources and Spatial Planning, which decides at first instance on the return of property protected under the regulations on nature conservation, has two pending cases at first instance and 3 cases in the appeal. A total of 39,714 denationalisation claims were submitted to all administrative bodies at the first instance of decision-making (administrative units, MK, MKGP, MOP and MF), of which 39,614 cases were finally closed, representing 99.75 % of the total number of cases submitted. There are still 100 pending cases, of which there are 61 pending cases at first instance, and a total of 39 cases are pending in the appeal at second instance and at the administrative and supreme courts. The second-instance ministries resolved 6 denationalisation cases over a period of three months, with a total of 15 denationalisation cases (MKGP — 5, MNVP — 7 and MGTŠ — 3).
