资源简介:

This study evaluates the impact of decisions of the East African Court of Justice (EACJ) on the protection of human rights in Tanzania. Although the EACJ was established primarily to interpret and apply the Treaty for the Establishment of the East African Community (EAC Treaty), its jurisprudence has significantly influenced the promotion of human rights through the enforcement of the Treaty’s principles of democracy, the rule of law, good governance, and accountability. The study examines key EACJ decisions involving Tanzania, including cases concerning freedom of expression, media freedom, access to justice, and public interest litigation, and assesses their contribution to legal and institutional reforms. It also explores the extent to which these decisions have strengthened judicial accountability, expanded access to justice, and encouraged compliance with regional human rights standards. Using a doctrinal legal research methodology based on the analysis of treaties, case law, legislation, and scholarly literature, the study finds that EACJ decisions have positively influenced human rights protection in Tanzania by shaping legal discourse and promoting reforms. However, their overall effectiveness remains constrained by challenges such as weak enforcement mechanisms, delays in implementation, limited jurisdiction, and political resistance. The study concludes that while the EACJ has emerged as an important regional mechanism for advancing human rights, greater commitment by the Tanzanian government to implement its judgments, alongside increased public awareness and stronger regional enforcement mechanisms, is essential to maximize the Court's impact on human rights protection.
