Regulatory Control in Wind Energy Areas Post-Lease Sale

This report explores the control that the Bureau of Ocean Energy Management (BOEM) and the Bureau of Safety and Environmental Enforcement maintain over Wind Energy Areas post-lease sale for offshore wind energy development on the Outer Continental Shelf. In addition, this report examines the broad discretion and authority that BOEM has in implementing final lease sale terms and stipulations and approving a lessee’s plan to conduct construction and operations related activities in the lease area.
