THE RIGHT TO A CLEAN AND HEALTHY ENVIRONMENT AND ECOLOGICAL MIGRATIONS

Summary: The right to a clean and healthy environment is one of the collective rights of<br>third generation human rights, its protection is certainly a destination to which humanity<br>should strive in the face of contemporary world problems. Management of natural<br>resources, which is important for the economy of every state, coupled with the policy of<br>sustainable development have a definite influence on the increase of violations of that<br>rights, especially in developing countries. In this article authors made an attempt to define<br>of the law on the basis of legal regulations and the concept of environmental migration and<br>environmental refugees.

摘要：清洁健康环境权是第三代人权（third generation human rights）的集体权利之一。在应对当代全球各类问题时，对该项权利的保护无疑是人类应当不懈追求的目标。自然资源管理对各国经济发展至关重要，再叠加可持续发展政策的推行，会显著加剧该项权利遭到侵害的情况，这一现象在发展中国家尤为突出。本文中，作者尝试以法律规范为基础，结合环境移民与环境难民的概念，对该项权利的法律内涵展开界定研究。
