Classification of rivers as list 1 and 2 (under Article L214-17 of the Environmental Code) in Corrèze
An Ecological Continuity Classification corresponds to all or part of a course or channel identified in an order made by the Basin Coordinating Prefect pursuant to Article L.214-17 of the Environmental Code.
The classification into list 1 (1° of § I of Article L. 214-17 of the Environmental Code) is intended to protect certain rivers from degradation and allows a long-term preservation objective to be displayed. They cancel, replace, and complete the classification as “reserved rivers” under the 1919 Act.
List 2 (2° of § 1 of Article L. 214-17 of the Environmental Code), annuls, replaces and supplements the concept of ‘rivers classified’ under L. 432-6 of the Environmental Code, must make it possible to ensure quickly that existing works are compatible with the objectives of ecological continuity.
The founding regulatory text of an Ecological Continuity Classification is the classification order signed by the Basin Coordinating Prefect in accordance with the procedure laid down in Article R.214-10 of the Environmental Code providing for departmental consultation of classification projects before validation by the Basin Coordinating Prefect.
The classification of rivers in respect of the crossing of migrants is carried out under 2° (list 2) of Article L.214-17-I of the Environmental Code for the criterion “courses for which it is necessary to ensure the circulation of migratory fish (amphihalins or not)”.
* On rivers in List 1, any new work, regardless of its use (hydroelectric or not) may not be authorised or granted.
List 1 is the counterpart of reserved streams. However, in relation to reserved watercourses, List 1 does not limit the prohibition to new water companies but prohibits the establishment of any new works regardless of their use.
With list 1, existing construction is possible. However, requirements apply to any development or renewal of a concession or authorisation in order not to degrade the status of the watercourse, to achieve the objectives of good status or very good status of the watercourse set by the SDAGE (the Master Plan for Water Management and Management), and to ensure, for watercourses where there is a need, the protection of migratory fish.
* On List 2 streams, all works must be managed, maintained and equipped to allow sufficient sediment transport and migratory fish circulation within 5 years of the publication of the Order.
List 2 is the counterpart of rivers classified under Article L432-6 of the Environmental Code. However, in relation to classified streams, List 2 adds that the works on these courses in addition to being transparent to fish must be transparent to sediments.
ATTENTION
* Some streams or stream sections may be on both lists.
* The old classifications (reserved rivers and rivers classified under Article L432-6 of the Environmental Code) are now obsolete.

生态连续性分类的法定生效依据为流域协调省长依据《环境法典》第R.214-10条规定的程序签署的分类命令,该程序要求在流域协调省长核准分类方案前,需完成省级层面的方案征询。
针对洄游鱼类通行的河流分类,依据《环境法典》第L.214-17-I条第2目(即清单2)中“需保障洄游鱼类(包括咸淡水洄游与淡水洄游物种)通行的河道”这一判定标准开展。
* 对于清单1内的河流,任何新建工程(无论是否用于水电开发)均不得获批或授予许可。
清单1是“保留河道”的对应分类,但与保留河道不同的是,清单1并非仅限制新建水利工程,而是禁止任何类型的新建工程。
清单1范围内允许保留既有建筑,但针对特许经营权或许可证的任何扩建或续期工程,均需满足以下要求:不得降低河道的生态等级,需实现《水管理与治理总体规划》(Schéma Directeur d'Aménagement et de Gestion des Eaux,简称SDAGE)设定的河道良好或优良生态状态目标,并在有需要的河道中落实洄游鱼类保护措施。
* 对于清单2内的河道,所有现有工程均需在分类命令发布后的5年内完成改造、维护与配套设施升级,以保障充足的泥沙输运能力与洄游鱼类通行条件。
清单2是《环境法典》第L432-6条所定义“已分类河流”的对应分类,但相较于原已分类河道,清单2额外要求河道上的工程不仅需保障鱼类通行,还需满足泥沙通透的要求。

* 部分河道或河道区段可能同时被划入两个清单。
* 原有的“保留河流”以及依据《环境法典》第L432-6条认定的“已分类河流”分类现已废止。
