The scope of the heads of holdings or agricultural enterprises excludes farmers or heads of agricultural enterprises whose holdings are less than the minimum taxable activity (MAA). The Law of the Future for Agriculture, Food and Forestry of 13 October 2014 amended the conditions for non-employed persons to join the agricultural scheme. Until now, in order to be automatically affiliated with the Social Protection Scheme for Non-Employed Agricultural Employees (MSA) as head of holding or agricultural enterprise, it was necessary to: — directing and developing an area of at least half the Minimum Installation Area (MIS) of its department, — or, where the SMI criterion could not be taken into account, devote at least 1200 hours of work per year to the conduct of its agricultural activity. From now on, the law replaces the criteria for non-employed agricultural workers — half SMI or working time — with a single concept: the Minimum Taxation Activity (MA). Thus, in order to become automatically affiliated to the social protection scheme of non-employed agricultural workers, as head of holding or agricultural enterprise, the importance of agricultural activity must correspond to one of the WADA criteria: — the area developed must be at least equal to the Department’s Minimum Coverage Area (MAA). —where the agricultural area cannot be taken for reference, the working time spent on agricultural activity must be at least 1200 hours per year. —for membership as head of farm or agricultural enterprise, the professional income generated by the agricultural activity must be equal to or greater than 800 Smic.
