87 Cents on the Dollar — Where California Proposition 65 Settlement Money Goes: 7,602 Reported Private Settlements, 2016–2026

Settlement-level dataset of every Proposition 65 settlement (7,602) and judgment (2,909) reported to the California Attorney General under Health & Safety Code § 25249.7(f) between 1 January 2016 and 13 March 2026. Headline: of $205,487,239 paid by businesses in reported settlements, $179,871,244 (87.53%) was attorney's fees and costs, $24,529,702 (11.94%) civil penalties and $1,086,293 (0.53%) other payments. Applying the statutory 75/25 penalty split (§ 25249.12(c)), the state's Safe Drinking Water and Toxic Enforcement Fund received roughly $18.4M — about 9 cents of every dollar, and 9.8× less than attorneys received. The fee share rose from 78.35% (2016) to 89.41% (2025). Court-entered judgments over the same period allocate 73.67% to fees, 13.9 points less than settlements reported without a judgment. Context that must accompany these figures: Proposition 65 is a private-attorney-general statute. § 25249.7(d) permits any person to sue in the public interest, and fee recovery is the deliberate mechanism that makes private enforcement possible for plaintiffs who recover no damages. A high fee share is what the statute was designed to produce; this dataset measures its size and drift, not its legality. Provenance and cleaning: amounts are taken from the Attorney General's own separated columns — nothing is regex-scraped or estimated, and total = penalty + other + fees holds for every row (asserted programmatically). 74 exact duplicate rows in the source export were removed; leaving them in shifts the headline to 87.57%. Plaintiff names are normalised for spelling variants (190 raw spellings, 168 distinct enforcers). The AG's internal settlement ID is reused across years and is not a stable key; the 60-day notice number is, and is what is published here. Limits: 2026 covers only 1 January – 13 March (299 resolutions) and is flagged partial.
