This article analyzes the instrumental effectiveness of Colombian law in protecting victims of gender-based violence in Chocó, Colombia, highlighting the structural, cultural, and intersectional barriers that limit its impact. It explores the potential and ethical challenges of integrating artificial intelligence into criminal justice processes, and provides evidence-based policy proposals for a more humane, efficient, and victim-centered legal system. El artículo examina la eficacia instrumental del derecho colombiano frente a la violencia de género en Chocó, resaltando las barreras estructurales, culturales e interseccionales. Se exploran los desafíos éticos y prácticos de la inteligencia artificial en la justicia penal y se proponen políticas públicas centradas en la víctima.
