Decisions of the Disciplinary CNESER 2008-2022

This dataset compiles the decisions of the Disciplinary CNESER, a national court that decides on appeal for faculty-researchers and teachers of the superior, and students prosecuted by their institutions for acts punishable by disciplinary action, published in the Official Bulletin of the MESRI, between 1 January 2008 and 31 December 2022. According to Article R232-42 of the Education Code, any decision of the disciplinary CNESER must be published in the OB. These decisions were read by the journalists of the AEF news editorial and the information was provided manually by them. This game includes 1,288 decisions and 14 variables: 1. OB number and date 2. File registered under number(s) 3. Date of decision 4. Year of decision 5. Establishment concerned (name was kept as at the time of the facts) 6. Target person (student, lecturer, university professors...) 7. Target person => title developed 8. Nature of the decision (decision on the merits, suspension of execution, withdrawal of appeal...) 9. Type of fact complained of (see below) 10. Main elements underpinning the decision 11. Decision 12. Link to the decision 13. Link to possible AEF dispatches 14. Decision of the local commission at first instance (initial penalty) In the 2008-2022 dataset, the variable ‘type of facts complained of’ has 12 values corresponding to the following code: 1. Physical or verbal violence, insults, assaults, threats 2. Psychological harassment 3. Defamation, damage to the image of others or establishment, failure to comply with the obligation to reserve, probity or exemplarity 4. Discriminatory acts or words (such as anti-Semites, racists, homophones, disabilities) 5. Gender and sexual violence 6. Damage to the property of another person or establishment 7. Infringement of scientific integrity and/or intellectual property, plagiarism 8. Fraud at an Examination 9. Falsifications of administrative documents 10. Acts of corruption or assimilated or of a financial nature (misappropriation, trafficking of influence, etc.) 11. Breaches of professional obligations, administrative misconduct, irregularities 12. Disrespectful, disruptive or inappropriate user behaviour, insubordination These categories are not exclusive and are separated by vertical traits when a case corresponds to more than one category. This nomenclature is also specified in a separate tab in the Excel file. The 2008-2022 dataset is an update of previous census work ending in 2019. The categorisation of the alleged facts has since been reworked, in order to better take into account the VSS in particular, and to no longer use the category “disorder to order and the proper functioning of the establishment”, which is too broad and which applies to all the misconduct sanctioned. However, here are the 13 values used in the 2008-2019 dataset: 1 Physical or verbal violence, assaults, threats 2 Harassment 3 Defamation, damage to the image of others or establishment (+ failure to comply with the obligation to reserve) 4 Other disrespectful or inappropriate behaviour 5 Facts or remarks of a character of hatred 6 Facts or remarks of a sexist and/or sexual nature 7 Infringement of the property of another person or establishment 8 Impairing scientific integrity and/or intellectual property 9 Fraud at a Review 10 Other frauds and document falsifications 11 Financial facts, corruption 12 Failure to comply with professional obligations 13 Other infringements of the institution’s order and functioning (+ administrative errors) These categories are not exclusive and are separated by commas when a case corresponds to more than one category. For example, a sexual harassment case is listed by codes 2.6. Furthermore, the dataset ending in 2019 does not include decisions at first instance, which have since been added.本数据集汇编了纪律性CNESER（Disciplinary CNESER）作出的裁决。该机构为国家级法院，负责审理高等院校教研人员、教师就所属机构作出的纪律处分决定提起的上诉，以及被机构追究纪律处分责任的学生的上诉案件。相关裁决均刊载于法国高等教育与研究部官方公报（Official Bulletin of the MESRI，简称OB），时间范围为2008年1月1日至2022年12月31日。根据《教育法典》第R232-42条规定，纪律性CNESER作出的所有裁决均须在官方公报中发布。上述裁决由AEF新闻编辑部（AEF news editorial）的记者整理摘录，信息均由其手动采集。 本数据集包含1288份裁决及14项变量： 1. 官方公报编号与发布日期 2. 归档文件编号 3. 裁决作出日期 4. 裁决年份 5. 涉事机构（保留事实发生时的机构名称） 6. 涉事主体（学生、讲师、大学教授等） 7. 涉事主体头衔（经规范表述） 8. 裁决性质（实体裁决、执行中止、上诉撤回等） 9. 投诉事实类型（详见下文） 10. 裁决核心依据 11. 裁决内容 12. 裁决原文链接 13. 相关AEF报道链接 14. 地方初审委员会裁决（初始处罚决定） 在2008-2022年数据集的“投诉事实类型”变量中，共包含12类对应编码的事实类型： 1. 身体或言语暴力、侮辱、殴打、威胁 2. 心理骚扰 3. 诽谤、损害他人或机构形象、违反保密义务、廉洁义务或表率义务 4. 歧视性言行（如反犹主义、种族主义、恐同言论、针对残障人士的歧视等） 5. 性别暴力与性暴力 6. 损毁他人或机构财物 7. 侵犯学术诚信及/或知识产权、抄袭 8. 考试舞弊 9. 伪造行政文书 10. 腐败或同类行为、金融类违规（如挪用公款、权力寻租等） 11. 违反职业义务、行政失当、违规操作 12. 不尊重他人、扰乱秩序或不当言行、不服从管理 上述分类并非互斥，若某一案件对应多个分类，各分类间以竖线分隔。该分类标准亦在Excel文件的单独工作表中列明。 2008-2022年数据集是2019年终止的既往普查工作的更新版本。此后，涉事事实的分类标准进行了修订，以更好地纳入性暴力与性骚扰（Violence et Harcèlement Sexuels，简称VSS）相关内容，同时不再使用“扰乱机构秩序与正常运行”这一过于宽泛的分类——该分类涵盖了所有应受制裁的违规行为。以下为2008-2019年数据集所使用的13类事实分类： 1. 身体或言语暴力、殴打、威胁 2. 骚扰 3. 诽谤、损害他人或机构形象（+违反保密义务） 4. 其他不尊重或不当行为 5. 仇恨性质的事实或言论 6. 性别歧视及/或性性质的事实或言论 7. 侵犯他人或机构财物 8. 损害学术诚信及/或知识产权 9. 考试舞弊 10. 其他舞弊与伪造文书行为 11. 金融类违规、腐败 12. 违反职业义务 13. 其他扰乱机构秩序与运行的违规行为（+行政失误） 上述分类并非互斥，若某一案件对应多个分类，各分类间以逗号分隔。例如，某性骚扰案件将被标注为代码2.6。此外，2019年终止的数据集未包含初审裁决，该部分内容现已补充至本次数据集中。
