Aeronautical clearance easements (T4-T5) – right-of-way

Aeronautical clearance easements which include the prohibition on creating or the obligation to remove obstacles which may constitute a danger to air traffic or harmful to the operation of safety devices established in the interest of air navigation. A plan of aeronautical alternate easements shall be drawn up for the following aerodromes and facilities: (1) aerodromes intended for public air traffic or created by the State; (2) Under conditions laid down by regulation at certain aerodromes not intended for public air traffic and created by a person other than the State and at aerodromes situated in foreign territory for which alternate zones must be established in French territory; (3) to installations for air navigation aids, aeronautical telecommunications and meteorology installations relevant to the safety of air navigation, without prejudice to the application of the provisions of articles L. 54 to L. 64 and R. 21, R. 24 to R. 28, R. 30 to R. 38, R. 40 to R. 42 of the Post and Electronic Communications Code relating to easements established in the interest of radio transmissions and receptions; (4) At certain locations corresponding to preferential crossing points for air navigation. This layer represents the right-of-way of the airport linked to this easement.航空净空地役权（aeronautical clearance easements）包含两项要求：一是禁止搭建可能危及空中交通安全、或损害为航空导航利益所设安全装置运行的障碍物；二是负有移除此类障碍物的义务。 应针对以下机场及设施编制航空备用净空地役权方案： (1) 供公共空中交通使用或由国家兴建的机场； (2) 针对特定非供公共空中交通使用、且由非国家主体兴建的机场，以及位于外国领土且需在法国境内划定备用区域的机场，按法规规定的条件编制方案； (3) 与航空导航安全相关的航空导航助航设施、航空电信及气象设施，但不得影响《邮政与电子通信法典》中有关无线电传输与接收地役权的L.54至L.64条、R.21、R.24至R.28、R.30至R.38、R.40至R.42条规定的适用； (4) 对应航空导航优先穿越点的特定点位； 本图层代表与该等地役权相关联的机场通行权。
